01Parties পক্ষসমূহ
This Waiver is made between Cox's Bazar Surf Hub Private Limited, its instructors, coaches, employees, and agents ("the Company") and the undersigned Participant. Where the Participant is a minor (under 18), this must be executed by a parent or legal guardian. এই অঙ্গীকার কক্সবাজার সার্ফ হাব এবং অংশগ্রহণকারীর মধ্যে। অংশগ্রহণকারী ১৮ বছরের কম হলে অভিভাবক স্বাক্ষর করবেন।
02Scope of Activities Covered কার্যক্রমের পরিধি
This Waiver applies to all physical activities offered by the Company, including:
- Surfing lessons — all levels
- Surfboard & equipment rental
- Surf safari & guided ocean excursions
- Open water swimming
- Gym & fitness facility use
- Personal coaching & training sessions
- Beach yoga, stretching & fitness classes
- Stand-up paddleboarding (SUP)
- Beach events, competitions & tournaments
- Any other physical activity hosted or facilitated by the Company
03Acknowledgement of Inherent Risks অন্তর্নিহিত ঝুঁকি স্বীকার
The Participant acknowledges that the activities listed above carry inherent risks that cannot be entirely eliminated, including:
Water & Ocean Risks
- Drowning or near-drowning
- Rip currents, tides, and strong surf
- Submerged rocks, reefs, or debris
- Equipment failure or unexpected board impact
- Marine life encounters (jellyfish, sea urchins, sharks)
- Sudden changes in weather or sea conditions
Physical Activity Risks
- Muscular strains, sprains, and fractures
- Head, neck, and spinal injuries
- Heat exhaustion and sunstroke
- Dehydration
- Cardiovascular stress during exertion
- Equipment-related injuries in gym or coaching settings
The Participant confirms they are in adequate physical health and fitness to undertake the selected activity and have disclosed all relevant medical information to the Company.
04Release of Liability দায়মুক্তি
In consideration of being permitted to participate in Company activities, the Participant (for themselves, their heirs, executors, administrators, and legal representatives) irrevocably agrees to:
- Release, discharge, and hold harmless the Company, its directors, instructors, employees, volunteers, and agents from any and all claims, damages, losses, or liabilities arising from participation in activities, including claims arising from negligence of the Company, to the fullest extent permitted by Bangladeshi law.
- Indemnify the Company against any third-party claims arising from the Participant's actions during an activity.
This release does not apply in cases of gross negligence or wilful misconduct by the Company. কোম্পানির স্থূল অবহেলা বা ইচ্ছাকৃত অসদাচরণের ক্ষেত্রে এই অব্যাহতি প্রযোজ্য নয়।
05Medical Fitness Declaration চিকিৎসা ফিটনেস ঘোষণা
The Participant declares that:
- They are physically and mentally fit to participate in the chosen activity.
- They have no medical condition, disability, or impairment that would endanger themselves or others.
- They have disclosed all relevant health information to Company staff prior to participation.
- They consent to emergency medical treatment if required, and agree to bear all associated costs.
06Rules, Instructions & Removal Policy নিয়ম ও অপসারণ নীতি
The Participant agrees to:
- Follow all safety rules and instructions issued by Company staff and instructors.
- Use all equipment as directed and not tamper with safety gear.
- Report any injury or safety concern to staff immediately.
The Company reserves the right to remove any participant from an activity at any time for non-compliance with safety rules, disruptive behaviour, or intoxication. No refund will be issued in such cases.
07Photography & Media Consent ফটো ও মিডিয়া সম্মতি
The Participant consents to the Company capturing photographs and video during activities for promotional use unless they opt out in writing prior to their session. This consent covers use on social media, the Company's website, and marketing materials.
08Data Consent তথ্য সম্মতি
The Participant consents to the Company recording and processing their personal data (including health information) as necessary for the safe delivery of services, in accordance with the Company's Privacy Policy and the Digital Security Act 2018.
09Governing Law শাসনকারী আইন
This Waiver is governed by the laws of Bangladesh. Any disputes shall be subject to the jurisdiction of the courts of Cox's Bazar District.
